Features: To address the issue of inconsistent case filing standards for dereliction of duty and infringement cases in practice, the Supreme People's Procuratorate issued the "Regulations on Case Filing Standards for Dereliction of Duty and Infringement Crime Cases" on July 26. This interpretation stipulates the case filing standards for 42 offenses of dereliction of duty and infringement crime as defined in the Criminal Law, providing an important legal tool and basis for the procuratorial organs' anti-derelection and anti-infringement work. Of course, the promulgation of the new interpretation does not mean it can solve the series of problems currently encountered in handling dereliction of duty and infringement cases. In light of this, our publishing house has organized relevant experts from academia and the practical field to compile this book based on criminal law provisions and referencing judicial interpretations, drawing on the latest academic research to provide some reference for understanding the interpretation. The book exhibits the following features:
1. Grasps the forefront of theory. The book absorbs the latest research findings and authoritative views on dereliction of duty and infringement crimes in the field of criminal law, discarding outdated and obsolete perspectives, and adopts the latest authoritative views to interpret the regulations in conjunction with the "Regulations on Case Filing Standards for Dereliction of Duty and Infringement Crime Cases."
2. Closely aligns with judicial practice. The book primarily focuses on legal annotations, but also clarifies ambiguous issues in the investigation and handling of dereliction of duty and infringement cases, particularly distinguishing some easily confused offenses in practice, making it highly practical.
3. Highlights key points. The book primarily explains issues related to dereliction of duty and infringement crimes, but covers less frequently used or less problematic offenses in judicial practice, aiming to concentrate on in-depth analysis and discussion of offenses with more difficulties in practice to meet the needs of judicial practice.
4. Comprehensive content. The book is based on but not limited to the "Regulations on Case Filing Standards for Dereliction of Duty and Infringement Crime Cases," while also including the Criminal Law and other relevant judicial interpretations, as well as issues such as the constitutive elements of crime in criminal law theory. It not only provides theoretical elaborations but also relevant legal grounds, making the format relatively complete.
We hope, through the joint efforts of the compilers and publishers, that this book can provide readers with some useful references. Of course, the book is inevitably incomplete, and we kindly ask readers for their understanding and to offer valuable suggestions for revision in the future.
