Features: Residing in a study, with no intention of chasing trends; immersed in writing, with a desire to apply knowledge. Moreover, at the age of forty, one's demeanor should be even more composed. Unexpectedly, a group of youthful and formidable young scholars, dedicated to the theoretical research and practical exploration of civil law, proposed the establishment of a Civil Law Salon to seek mutual learning, refine scholarship, and complement each other's strengths. From the outset, the initiators invited me to participate, and after careful consideration, I readily agreed. After several study sessions with the group, my initial intentions became increasingly clear. Discussing civil law issues requires an academic platform. While one's efforts can certainly produce original insights, pooling the wisdom of many can help refine and elevate the discourse. If the participants are of similar expertise yet diverse perspectives, with the ability to engage in equal dialogue, pursue the essence of civil law, and speak freely, then not only can existing conclusions be questioned, but new perspectives may also emerge. Regardless of age, all participants are equal members. Some may report, others comment; some listen, others seek guidance; some present arguments, others defend them. All these activities benefit both the individual and the group in enhancing civil law knowledge.
Improving one's civil law expertise requires both learning and reflection. Identifying civil law issues requires considerable knowledge; otherwise, even when problems are right before one's eyes, they may be overlooked or misinterpreted. Solving civil law issues demands an even higher level of insight; otherwise, faced with social realities, one may be helpless or resort to superficial solutions. Such insight is neither innate nor magically acquired—it can only be cultivated through dedicated study of classics, supplemented by deep contemplation, debate, and gradual accumulation. "Learning without reflection is wasted; reflection without learning is perilous." How true this is! The Civil Law Salon resembles a school for reading classics and exchanging insights, where one may gain a broader perspective and reach new heights.
Developing civil law theory requires appropriate methods. Examining the history of civil law development reveals that various schools of thought each have their unique merits and rightful place. For salon members, the essence of different legal methodologies must be deeply understood, and knowledge from related disciplines needs gradual supplementation. The Civil Law Salon aims to be a space for free expression, encouraging diversity and fostering intellectual debate. While members may have different academic interests and varying allegiances to legal schools, the collision of different methods and perspectives can spark inspiration and mutual prosperity.
Elevating legal standards requires academic criticism. Free expression, equal discussion, serious criticism, and sincere responses are the hallmarks of academic progress. In contrast, the Chinese civil law academia often engages in self-praise while rarely responding to criticism, creating an illusion of vitality but lacking true prosperity. The Civil Law Salon practices confrontational debates, encourages unfiltered criticism, appreciates insightful opinions, and rejects blind conformity.
Interpreting civil law theory must adhere to academic norms. Without rules, there can be no order. Reports in the Civil Law Salon must follow logical reasoning and citation standards. Comments must be scrutinized from the topic's value to the correctness of viewpoints, punctuation, and citations. The Civil Law Salon is an open academic forum. Whether joining out of shared interests, being too busy to attend, or losing interest over time, participation is voluntary, and departures are normal.
