This book is a microcosm and crystallization of the five-year intellectual property adjudication work of the Shanghai Courts, serving as an important window for readers to understand Shanghai's intellectual property adjudication work. I believe the book has the following features:
1. The cases included are typical, cover a wide range, and are representative. The selected cases are carefully chosen from nearly a thousand intellectual property cases adjudicated by the Shanghai Courts in recent years. They are characterized by significant social impact and complex legal relationships. There are a total of 14 selected cases, including 4 cases involving foreign elements, 3 cases involving Hong Kong and Taiwan, 6 copyright cases, 4 trademark cases, 2 cases of unfair competition, 1 case of patent rights, and 1 case of theft of trade secrets. In these cases, several judgments have been recognized by the Supreme People's Court, published in the Supreme People's Court Gazette, or used in the Supreme People's Court press conference.
2. It is the first to adopt the format of judgment documents combined with comments by the presiding judges. This format enhances the authenticity and authority of the book.
3. It is the first to adopt a bilingual (Chinese-English) format. This is the first bilingual case selection compiled by the Shanghai Courts. The purpose of adopting this format is to promote and introduce China's intellectual property legal system to domestic and international audiences, as well as to showcase the judicial protection of intellectual property rights by the Shanghai Courts.
4. The analysis is both in-depth and accessible, emphasizing the combination of theory and practice.
