The interpretations and requests for instructions from the Supreme People's Court (SPC) and the Supreme People's Procuratorate (SPP) play an indispensable guiding role in ensuring the correct application of laws and the smooth progress of judicial work. We have integrated the currently effective interpretations and requests for instructions into four volumes: Civil Volume, Commercial Volume, Criminal Volume, and Administrative·Compensation for Injuries Volume, for the reference of staff in judicial practice departments. The characteristics are as follows:
Comprehensive and Practical
We strive to comprehensively include the currently effective judicial documents of the SPC and SPP, including internal reference documents of the divisions and approval documents for individual cases. Although these internal reference documents and individual approval documents may not be universally applicable, they represent the stance of the SPC and SPP in handling specific cases or applying laws during a certain period. They serve as supplements to the then-existing laws or interpretations and hold significant reference value. Additionally, we have included some legal documents closely related to judicial documents (e.g., the General Principles of the Civil Law of the People's Republic of China) and appended them to the relevant judicial documents for systematic reference.
Scientific Format
The documents are subdivided into several categories, and within each subcategory, judicial documents are arranged by Interpretations, Requests for Instructions, and Related Legal Links. The arrangement follows these principles: According to the "Provisions of the Supreme People's Court on Judicial Interpretations" and the "Interim Provisions of the Supreme People's Procuratorate on Judicial Interpretations," judicial documents of the SPC are divided by the boundary of July 1, 1997, and those of the SPP by the boundary of December 9, 1996. Judicial documents issued before these dates, except those titled "Telephone Replies," are classified under Interpretations. Those issued after these dates, except those titled "Interpretation," "Regulation," "Approval," "Notice," or "Opinion," are classified under Requests for Instructions. Within the same subcategory, interpretations or requests for instructions are arranged by issuance date to facilitate readers' searches.
