Features: Since the revision of the Criminal Law of the People's Republic of China (hereinafter referred to as the Criminal Law) in March 1997, the Standing Committee of the National People's Congress has, in accordance with changes in circumstances, successively passed the Decision of the Standing Committee of the National People's Congress on the Crime of Fraudulently Purchasing Foreign Exchange, Evading Exchange Control, and Illegally Trading Foreign Exchange (hereinafter referred to as the Decision) and six Criminal Law Amendments, modifying and supplementing the Criminal Law. Currently, dozens of articles of the Criminal Law have been amended or deleted, with eight different effective dates. To facilitate judges, prosecutors, lawyers, and others in studying and applying the Criminal Law, we have specially compiled this Criminal Law text based on the Decision of the Standing Committee of the National People's Congress, the Criminal Law Amendments, and the practical needs of criminal case handling. This text has been reviewed and approved by the Criminal Law Office of the Legal Affairs Commission of the National People's Congress. The book employs the following legal compilation techniques:
1. "Annotations." The newly added content in the Decision is presented in the form of annotations in Section 4 of Chapter 3 of the Criminal Law, which deals with crimes against the financial management order.
2. "Notes." The modifications made in the Decision and the content of the amendments are directly incorporated into relevant articles of the Criminal Law, with notes in different fonts indicating the additions, deletions, and effective dates of the amendments.
3. "Article Index" and "Comparison Table of Articles Before and After Amendments." In the appendix, an Article Index of the Criminal Law (Main Themes and Crime Names) and a Comparison Table of Articles Before and After Amendments are provided to facilitate readers in locating relevant articles.
The book also includes the full text of the Decision, the Criminal Law Amendments, legislative interpretations on criminal law, and other regulations. The new crime names in the Article Index are drafted by the compilers and are subject to the judicial interpretations on the determination of crime names to be announced by the Supreme People's Court and the Supreme People's Procuratorate in the future.
