Author: Edited by the Editorial Committee of the Peking University Law Review
Publisher:
Publication Date: 2006-06-01
Features: This issue of the Review mainly includes three parts: "Papers," "Commentaries," and "Peking University Forum." "How Law Is Possible" is a paper that systematically studies Luhmann's sociology of law. "Public Torts and Mass Product Liability" explores a recently emerging type of litigation in the field of U.S. tort law, providing a good example for understanding the dynamics of tort law in foreign countries. "The Image of Justice" raises a fundamental question in legal philosophy—what is justice? Does justice have a standard image? The author examines the images of the goddess of justice in Western art from different periods and finds that there is no universal standard image, such as the depiction of eyes, which varies with different authors and contexts. "Wusong and the 'Shixie'" is a typical study in the field of "law and literature." "The 'Old Customs' in Civil Law and the Transformation of Governance Techniques During the Japanese Rule in Taiwan" is a legal history article that, through a description and analysis of the "old customs" in the civil law during Japan's colonial rule in Taiwan, presents a picture and dimension entirely different from the bloody suppression of criminal law. "Regulation or Competition" discusses the conflict between the application of the U.S. federal antitrust law and the regulation by state governments. "Intellectual Property and Publishing Systems Before the Digital Age" integrates the study of legal history, social history, and intellectual history. "The Single Regulator Model in the Context of Global Financial Reform" attempts to reevaluate the efficiency, effectiveness, and applicability of the U.S. single financial regulatory agency—the Financial Services Authority—from the perspective of post-event policy review, assessing its feasibility as an alternative model for financial regulation in global financial reform.
