Publish Date: 2005-03-01
Features: Humans are essentially "social beings," and their lives are deeply influenced by the ethnic, racial, and cultural groups they belong to within human society. Only when the Constitution is grounded in this understanding can it more fully reflect human values. This book offers a fresh perspective to recognize and analyze constitutional phenomena in human society. The ideological origins of constitutionalism are primarily the natural ideas long familiar to academia, which advocate that every person is born free and enjoys equal freedom and rights. In the constitutional practice since the Constitution's inception, the focus has remained on reflecting the entirety of human social life. The author argues that this theoretical framework itself can comprehensively reflect the entirety of human social life. Because humans are essentially "social beings," their lives are deeply influenced by the ethnic, racial, and cultural groups they belong to within human society. Only when the Constitution is grounded in this understanding can it more fully reflect human values. Constitutional anthropology is constructed based on this fresh perspective. This book features new theoretical content and structure. It is divided into two parts: the first part is background analysis and theoretical construction based on ethnic, racial, and cultural groups, including various knowledge and theoretical systems related to these groups; the second part is empirical analysis, which provides as comprehensive a summary and analysis as possible of Canada's multiculturalism and China's ethnic regional autonomy. This book exhibits the characteristics of a new discipline. Contemporary cutting-edge disciplines, marginal disciplines, and interdisciplinary fields are constantly emerging and gaining prominence. This work combines traditional constitutionalism with the burgeoning fields of cultural anthropology, legal anthropology, and philosophical anthropology, pioneering explorations and attempts to construct a constitutional anthropology theoretical framework that is both closely linked to traditional constitutionalism and possesses its own independent characteristics.
