Private Law (Issue 5, Volume 1)

Features: The book selects 13 papers, covering various fields of civil and commercial law, including civil law research, property rights, corporate law, negotiable instruments law, and more. Private Law advocates for the integration of private law as a unified discipline for comprehensive study, placing special emphasis on fundamental theories of private law. It is an innovative and theoretically sophisticated academic publication. In fact, the current draft Civil Code submitted for deliberation by the National People's Congress shows a tendency toward legislative arbitrariness, which is a result of the lack of general theoretical research on private law, particularly the lack of comprehensive studies that treat private law as a whole. Without an integrative understanding of private law systems, theories, and spirit, it is difficult to ensure that the Civil Code will have a complete system, and civil law may lose the inclusivity it should possess as a general law for civil society. It also risks causing us to lose our way in the process of drafting China's Civil Code. In this sense, the authors are delighted to witness the birth and growth of Private Law, hoping that it will continue to adhere to strict academic standards and rigorous academic norms, leaving a substantial legacy for the development of Chinese jurisprudence.
