Newly Drafted General Principles of the Civil Code Debt Compilation (Volume 1, New Edition)

Author: Qiu Chongzhi
Publisher:
Publishing Date: 2003-01-01
Features: Based on the previous edition, this book has been appropriately revised with significant changes, where many topics are almost entirely rewritten, hence the title "New Edition." Due to the extensive revisions, the book has become quite lengthy and is published in two volumes. The first volume primarily covers the occurrence of obligations and the objects of obligations. While maintaining the general style of the previous edition, this book still differs significantly in style. The revisions include:
(1) Strengthening the critical analysis of major controversial issues in the general theory of obligations through methodological reflection;
(2) Rigorous exploration of the context and systematic construction of legal interpretation;
(3) Careful consideration and prudent application of legal methodology, particularly teleological interpretation and analogy;
(4) A thorough review and specific examination of the amendments to the Obligations Chapter of the "Civil Code of the Taiwan Area."
It is hoped that these four aspects will help readers gradually delve into the realm of obligation law. The book offers numerous critiques of the amended articles in the Obligations Chapter of the "Civil Code of the Taiwan Area." With a humble perspective, the author wishes to share these views, hoping they may contribute, in some small way, to the precision and perfection of the obligation law system. However, with limited knowledge and potential biases, errors and omissions are inevitable. The author sincerely hopes that esteemed scholars, teachers, and friends will understand and kindly offer further guidance.
