Features: With the progress of socialist material and spiritual civilization in China, the construction of socialist rule of law in China has achieved remarkable achievements worldwide. One by one, criminal laws, civil and commercial laws, economic laws, and administrative laws have been successively promulgated by the state's highest organ of power. It can be said that we have basically achieved the goal of having laws to rely on, and the legal system for China's socialist market economy has also taken shape. This will undoubtedly play a huge role in ensuring the peace and livelihood of the Chinese people, maintaining orderly market competition, and enabling the government to govern according to law, as well as in building a socialist country under the rule of law.
The abstract nature of legal norms and the professionalism of legal language have created many obstacles for the general public in understanding legal content, while also posing certain difficulties for judicial and law enforcement workers in applying the law. Moreover, there are still many aspects of China's existing laws that need improvement. How to correctly understand and accurately apply the law has become an urgent issue before us. To help readers understand the specific content and judicial application of China's laws, we have invited experts and scholars from the Law Committee of the Standing Committee of the National People's Congress, the Supreme People's Court, the Supreme People's Procuratorate, Renmin University of China, China University of Political Science and Law, Peking University, and Southwest University of Political Science and Law to jointly write this series, "New Edition of Common Laws for the New Century." Following the order of legal articles, this series explains the legislative intent and specific application of each article in three parts: keyword explanations, understanding and application, and cases and commentaries, to prevent disagreements in application. In the "Understanding and Application" section, the content and application of the article are elaborated in detail. In the "Cases and Commentaries" section, selected cases related to the article are commented on to deepen understanding.
This series strives to reflect China's recent mature theories and judicial practices. All content is based on the latest laws, regulations, rules, and judicial interpretations, and modifications to relevant laws are clearly stated in the corresponding sections. Furthermore, we will update the series according to newly promulgated laws to provide readers with the most up-to-date information.
As this series is published, we have entered the 21st century. We dedicate this book to our great motherland, to our great era, and to those who have contributed to the development of China's legal system.
