The Marriage Law is an important part of China's socialist legal system, involving countless families and affecting men, women, the young, and the old. A scientific and comprehensive Marriage Law is key to maintaining family harmony and social stability. On May 1, 1950, China promulgated its first Marriage Law, which was later significantly revised and replaced by the second Marriage Law in 1980. Over the past 50 years, the principles of gender equality, monogamy, and marriage freedom stipulated in the Marriage Law have deeply rooted in society, and the legitimate rights and interests of women, children, and the elderly have been fully protected. Respect for the elderly, love between spouses, and equal, harmonious, and civilized marital and family relationships have taken shape. However, with the changing times, people's ideas and concepts have also evolved, leading to new situations and issues in marriage and family life. Therefore, it is necessary to revise and improve the Marriage Law to make it adapt to the needs of social development. At the turn of the century in 2001, under the historical backdrop of China's major socio-economic transformation, the Marriage Law underwent significant revisions. It summarized years of practical experience, elevating effective administrative regulations and judicial interpretations into law, while removing and revising provisions that no longer met the demands of the times or changes in family life. The revisions to the Marriage Law mainly involved the following aspects: (1) Issues related to bigamy; (2) Issues related to domestic violence; (3) Issues related to marital property systems; (4) Issues related to marriage requirements and invalid marriages; (5) Issues related to divorce; (6) Issues related to protecting the rights and interests of the elderly; (7) Issues related to legal liability. It can be said that the revision of the Marriage Law was a major step in the reform of China's marriage and family legal system, marking a new milestone in the development of China's marriage and family legal framework. In the more than one year since its implementation, the revised Marriage Law has effectively resolved a large number of marriage and family disputes, adhering to China's fine historical traditions while promoting justice. It has protected the legitimate rights and interests of individuals while fostering social stability. Practice has proven that the revised Marriage Law is a law that suits China's national conditions and reflects the characteristics of the times. However, during its implementation, the revised Marriage Law has encountered some new issues, and some newly established systems and regulations are too broad and lack operability. In response, the Supreme People's Court issued the "Interpretation of Several Issues Concerning the Application of the Marriage Law of the People's Republic of China (I)" on December 25, 2001, providing timely clarifications. To help people better understand the revised Marriage Law and the relevant provisions of the Supreme People's Court's "Interpretation of Several Issues Concerning the Application of the Marriage Law of the People's Republic of China (I)," this book starts with the small, everyday issues that concern the public, presents legal questions and answers in a simple and accessible language, and provides detailed explanations and analyses of legal provisions. The aim is to make the content easy to understand and apply. We hope this book can become a helpful guide for people's marriage and family life, contributing to marital happiness and family bliss.
