Features: Since the standardization of the Supreme People's Court's interpretations in 1997 until the end of 2005, the Supreme People's Court has published 236 interpretations (the "Fa Shi" series). These interpretations have played a significant role in helping the courts handle various cases and achieve the goals of justice and efficiency in judicial work. To assist readers in learning and accurately understanding the Supreme People's Court's interpretations and mastering the key points of judicial practice, our publishing house has successively launched the "Interpretation of the Supreme People's Court's Interpretations·Civil Volume (1997–2002)," "Interpretation of the Supreme People's Court's Interpretations·Criminal and Administrative Volume (1997–2002)," "Interpretation of the Supreme People's Court's Interpretations·Volume 2003," and "Interpretation of the Supreme People's Court's Interpretations·Volume 2004," which have been well-received and highly praised by readers. Given that some interpretations were published earlier and some of their provisions have been replaced by new interpretations, or the laws they were based on have been revised or abolished; additionally, some difficulties have emerged in their application after implementation, urgently requiring unified understanding. We have invited the authors of the "Interpretation of the Supreme People's Court's Interpretations Series" to comprehensively revise and supplement their original interpretive articles from a fresh perspective. The interpretations included in this book range from [1997]1 to [2005]13, categorized and organized into "Civil Volume," "Civil and Commercial Volume," "Criminal Volume," and "Administrative·State Compensation·Other Volume." The compilation model of this book is: "Standard Text of Interpretation" + "Interpretation" + "Links" + "Appendices." The "Interpretation" explains the background of the drafting and formulation of the interpretation, the issues or judicial principles it addresses in judicial practice, how to understand the difficulties and ambiguities, and how to apply it correctly, and so on. To enable readers to more conveniently and deeply grasp the interpretations, some important interpretations also include responses from relevant Supreme People's Court officials to journalists' questions on related issues and closely related regulatory documents, presented as "Links" and "Appendices" following the "Interpretation." The features of this book are: (1) Authoritative. All "Interpretations" are written by judges of the Supreme People's Court who drafted the interpretations, some of which have been reviewed and approved by the heads of relevant divisions, to reflect the essence of the interpretations and ensure high authority and professionalism, thereby preventing misinterpretation, distortion, or ambiguity. (2) Comprehensive. The "Interpretations" cover all currently effective interpretations of the Supreme People's Court since the standardization of interpretations in 1997 until the end of 2005. Some judicial documents of great importance to understanding and applying the interpretations are also selected as appendices in each chapter. (3) Up-to-date. The authors have revised the existing "Understanding and Application" of the interpretations based on new situations and issues in recent years. The interpretations and interpretive documents included in this book were all published by the Supreme People's Court after 1997. Interpretations and interpretive documents from before 1997 can be found in the "Interpretation of the Supreme People's Court's Interpretations (1980–1997)" (to be published). This volume is the "Administrative·State Compensation·Other Volume," divided into three parts: "Administrative," "State Compensation," and "Other."
