"The Expert Proposal Draft of the Personal Information Protection Law of the People's Republic of China and the Legislative Research Report" is the third volume in the "Personal Information Protection Research Series" by the Institute of Law, Chinese Academy of Social Sciences. In early 2003, the Information Office of the State Council commissioned the Research Group on Personal Data Protection Law under the Institute of Law, Chinese Academy of Social Sciences, to conduct a comparative study on the Personal Data Protection Law and draft an expert proposal draft, with Researcher Zhou Hanhua serving as the head of the research group. After nearly two years of work by the research team, both a mid-term and a final research report were produced. This report is the essence of the entire project. The manuscript mainly consists of 19 thematic reports, covering topics such as the establishment of the legal name, legislative models, the significance and importance of legislation, the current legislative status, and the basis for legislation. It also addresses the scope of legal application, exceptions to legal application and their regulatory methods, basic principles of personal information processing, the relationship with the Regulations on Government Information Disclosure, different regulatory approaches and their effects on government agencies and other personal information processors, balancing personal information protection with the promotion of information free flow, the application of the Personal Information Protection Law in specific industries, sensitive personal information, enforcement agencies, industry self-regulatory mechanisms, the rights of information subjects, cross-border information exchange issues, criminal liability issues, and the post-9/11 trends in international personal information protection policies, among a total of 19 specialized legislative reports. The manuscript is concise in language, rich in information, clear in argumentation, and addresses cutting-edge research topics.
