Features: This book is a research outcome of the National Social Science "Nineth Five-Year Plan" key project "Research on the Legal System of China's Foreign Service Trade." Through systematic research on this project, the author has theoretically established the basic principles, legal framework, content system, and legal relationship with GATS international rules of China's foreign service trade legal system. Practically, the author has proposed legal countermeasures and suggestions for China's service trade legislation and resolving practical issues in the market opening of China's service industry. The book aims to explain the framework structure and basic content of China's foreign service trade legal system in a clear and concise manner to a broad readership, and to correctly interpret and analyze the applicable rules of China's foreign service trade legal system in conjunction with the practice of China's service industry market opening. The basic structure and main characteristics of the book are as follows:
(1) The foreign service trade legal system elaborated in this book refers to the legal regulation of foreign service industries entering the Chinese market, and does not include China's service industry foreign investment legal issues. This is because China's total foreign investment, including the service industry, accounts for only 0.3% of the world's total stock.
(2) The foreign service trade legal system elaborated in this book objectively reflects the current status and characteristics of China's current foreign-related economic legislation or economic regulations.
(3) The book adopts the principle of combining theory with practice. The elaboration of the foreign service trade legal system is conducted from the perspective of legal application, with dynamic interpretation and analysis, always linked to the current status of China's service industry market opening and the practice of foreign investment access. It also provides legal countermeasures to resolve some practical issues in foreign service trade, which holds both significant theoretical significance and practical value. In the research on foreign service industries entering the Chinese market, the book specifically analyzes the applicable rules of the GATS market access principle, as well as the legal regulations and policy orientations for the opening of China's specific service markets.
