Features: Based on the Supreme People's Court's "Provisions on the Implementation of the People's Republic of China Criminal Law" issued in 1997, this book has undergone significant revisions and supplements according to the two additional "provisions" on the implementation of the criminal law announced by the Supreme People's Court and the Supreme People's Procuratorate in March 2002 and August 2003, respectively. The revised book exhibits three prominent features:
First, the content is up-to-date and highlights key points. It thoroughly studies and writes about the nine newly established crimes based on the two "additional provisions," in accordance with the Decision of the Standing Committee of the National People's Congress on Punishing the Crime of Fraudulently Purchasing Foreign Exchange, Evading Exchange Regulations, and Illegally Trading in Foreign Exchange (hereinafter referred to as the Decision) and the four Criminal Law Amendments, adding them to the original 413 crimes to cover a total of 422 crimes. The 23 revised crimes have also been rewritten one by one, with emphasis on newly established crimes, commonly used crimes, and revised crimes.
Second, it clarifies the basic spirit of legislation. For all provisions involving the application of the Decision, Criminal Law Amendments, and legislative interpretations, the legislative background is explained.
Third, it is highly practical. For each crime, it correctly elaborates on the fundamental theories of the People's Republic of China Criminal Law in terms of concepts and constitutive elements, fully explains the key issues to be noted when identifying crimes and applying penalties, and incorporates the content of more than 50 judicial interpretations on the implementation of the criminal law published by the "two highs." This is currently one of the most up-to-date, comprehensive, and practically valuable criminal law monographs on the division of the People's Republic of China Criminal Law published domestically.
