Features: Since the establishment of China's market economy system has laid the foundation for the formulation of the Civil Code, China's judicial practice has accumulated rich experience in the formulation of the Civil Code, and extensive civil law scholars have made substantial theoretical preparations. Therefore, it is entirely feasible to promulgate a comprehensive and substantive Civil Code that aligns with China's national conditions, which will provide strong guarantees for China's economic takeoff, cultural prosperity, and long-term stability in the 21st century. We have ample reasons to believe that the emergence of a Chinese-characterized, advanced, and comprehensive Civil Code will become a reality in the near future. If the promulgation of the French Civil Code in the early 19th century and the German Civil Code in the early 20th century became significant achievements in the history of global civil law development, then the promulgation of the Chinese Civil Code in the early 21st century will undoubtedly leave a glorious chapter in the history of civil law development.
Private Law advocates for the integrative study of private law as a unified discipline, placing particular emphasis on the fundamental theories of private law. It is an academic journal with high creativity and theoretical depth. In fact, the current draft of the Civil Code submitted to the National People's Congress for deliberation exhibits certain tendencies of legislative arbitrariness, which is a result of the lack of general theoretical research on private law, especially the lack of comprehensive studies on private law as a whole. This book is the second volume of the third issue of Private Law, adhering to the academic pursuit and manuscript selection criteria of Private Law. It features eleven high-quality academic papers, covering various aspects of the private law field and addressing issues that are currently at the forefront and hot topics in both theoretical and practical circles. Additionally, this volume includes an interview with Professor Liang Huixing and a Chinese translation of the South Korean Civil Code, both of which hold significant reference value. This book is suitable for legal researchers, law students, legal practitioners engaged in practical legal work, as well as individuals from other disciplines who are interested in law.
