1. While strengthening public order management, the General Provisions of this Law further specify the content of regulating the actions of public security organs and their people. It emphasizes that public order management should implement a comprehensive approach, resolve social conflicts, promote social harmony, and pay attention to protecting the legitimate rights and interests of citizens, legal persons, and other organizations.
2. The Regulations summarize the practical experience of nearly two decades of implementation and stipulate some basic principles that should be followed in public order management law enforcement activities.
3. To ensure that public security organs and their people engage in standardized law enforcement activities and strictly fulfill their duties in accordance with the law, a new chapter on "Law Enforcement Supervision" has been added.
4. Given that the Regulations provided relatively general and simple provisions on the procedures for handling public order cases, this Law further refines the procedural regulations to further standardize the law enforcement activities of public security organs and their people and protect the legitimate rights and interests of the parties involved.
5. In accordance with the needs of public order management, some new acts of violating public order management have been added.
6. To adapt to economic development and changes in social conditions, the range of penalties for fines has been appropriately increased.
On August 28, 2005, the 17th session of the Standing Committee of the 10th National People's Congress passed the "Public Order Administration and Punishment Law of the People's Republic of China." This law is of great significance for maintaining public order, ensuring public safety, protecting the legitimate rights and interests of citizens, legal persons, and other organizations, as well as standardizing and safeguarding the law enforcement responsibilities of public security organs and their people in accordance with the law.
To facilitate the study, publicity, and implementation of the Public Order Administration and Punishment Law, and to help a broad readership understand and master its content, the colleagues of the Criminal Law Office of the Legal Affairs Commission of the National People's Congress, who directly participated in the legislative work, jointly compiled the book "Interpretation and Practical Guide to the Public Order Administration and Punishment Law of the People's Republic of China."
Based on the legislative intent, the book provides a comprehensive and authoritative interpretation of the Public Order Administration and Punishment Law through the method of summarizing the essence of each article, and appends relevant legislative materials and documents.
