Features: Since the 1980s, with the continuous deepening of China's reform and opening-up and the development of socialism with Chinese characteristics, especially the progress in democratic and legal system construction, legal education, and research, through the joint efforts of legal scholars of all ages, the construction of legal textbooks has been constantly improved. This has contributed to cultivating thousands of applied, interdisciplinary, innovative, and high-quality legal talents, achieving remarkable historical merits. Entering the 21st century, China has entered a great period of building a moderately prosperous society in all respects, and the strategy of governing the country according to law is being fully implemented. Particularly after China's accession to the World Trade Organization, many new legal issues have emerged, requiring serious study. Legal education and research must adapt to the new situation, keep pace with the times, and innovate. Based on this understanding, we have organized renowned professors and experts from the legal community and practical departments to collaboratively write this series of "21st Century Innovative Legal Textbooks" in accordance with the "Basic Requirements for Core Course Teaching in Law Majors of Higher Education Institutions" compiled by the Higher Education Department of the Ministry of Education and the actual needs of China's democratic and legal system construction and legal education and research in the 21st century.
This series of textbooks is named "Innovative Textbooks" because we strive to innovate in both content and format compared to existing similar textbooks. In terms of content, we emphasize the unity of knowledge, theory, and practice, paying special attention to incorporating the latest achievements in domestic and international legal education and research, while also considering the guiding influence of the judicial examination on teaching and textbooks. In terms of format, each chapter of every textbook consists of key points and difficulties of the chapter, an introduction, main text, review questions, analysis of difficult cases (or typical examples), controversial issues, and key terms. Each book is followed by a bibliography of important literature and an index. The purpose of this arrangement is to enable readers to gain a comprehensive understanding of the key points, difficulties, main content, and related knowledge of each chapter, and to conduct in-depth thinking and research based on the clues provided in the textbook. Of course, this is just an attempt, and its feasibility and effectiveness remain to be tested by practice and evaluated by readers. We hope this series of textbooks can provide more effective help for readers, teachers and students, and candidates for the judicial examination in their learning and research. At the same time, we hope that experts and readers can offer criticism and suggestions so that they can be revised for the second edition. This is the preface.
This book has been organized in accordance with the outline of the core course textbooks for law majors approved by the Ministry of Education on behalf of the editorial committee of the "21st Century Innovative Legal Textbooks." This book has the following characteristics: (1) In terms of structure, considering the convenience and needs of student learning, each chapter includes key points and difficult issues, discussion questions, cutting-edge theoretical issues and representative works, and the entire book is accompanied by a bibliography, an acronym list, and a glossary of terms; (2) It pays attention to reflecting the latest provisions of legislative and judicial interpretations; (3) It focuses on cutting-edge theoretical issues and incorporates the latest achievements of discipline research; (4) It adheres to the principle of linking theory with practice, not only explaining legal norms from a theoretical perspective but also interpreting the meaning of legal provisions through specific cases; (5) It pays attention to introducing the basic content of the United Nations criminal justice standards and relevant foreign systems to broaden students' horizons.
