Features: Under the following circumstances, regardless of the cause of the loss of the insured vehicle or the economic liability to third parties, the insurer shall not be liable for compensation:
(1) War, military conflict, strike, riot, seizure, confiscation, government requisition;
(2) Use of the insured vehicle by a driver without the insured's permission;
(3) Intentional acts by the insured or the driver permitted by the insured;
(4) Competitions, tests, maintenance or repair at commercial repair facilities;
(5) The fall or leakage of goods carried by the vehicle;
(6) Towing of another vehicle (including trailers) or other towed items by the insured vehicle, provided that at least one of them is not insured for third-party liability;
(7) The driver being under the influence of alcohol, drugs, or anesthesia;
(8) The driver falls into any of the following categories:
- No driver's license;
- Driving a vehicle that does not match the type authorized by the driver's license;
- Driving a local vehicle with a military or armed police driver's license;
- Driving a military or armed police vehicle with a local driver's license;
- Driving with a learner's permit without an instructor present;
- Not following the designated time or route for learning to drive;
- Driving large buses, trams, hoisting vehicles, or vehicles with trailers during the probationary period without a qualified driver supervising;
- Driving police vehicles, fire engines, engineering rescue vehicles, ambulances, or vehicles carrying hazardous materials during the probationary period;
- Driving on a highway with a learner's permit or during the probationary period;
- Holding a driver's license that has not passed inspection or has expired beyond the inspection period, or driving without the approval of the public security traffic management department;
- Operating specialized mechanical vehicles or special vehicles without a valid operation certificate issued by relevant national departments, or driving rental vehicles or commercial coaches without a license or other certificates issued by the transportation management department;
- Other situations deemed as "no valid driver's license" as specified by the public security traffic management department.
(9) The insured vehicle fleeing the scene after an accident;
(10) Failure to pay insurance premiums as agreed in the insurance contract;
(11) Except as otherwise stipulated in this insurance contract, if the insured vehicle does not have a motor vehicle registration certificate, driving license, or license plates issued by the public security traffic management department, or if it is not inspected or fails the inspection at the time of the insurance incident, the insurer shall not be liable for compensation;
(12) The insured vehicle being used as a tool for criminal activities.
Article 4: The insurer shall not be liable for compensation for the following losses and expenses:
(1) Business interruption, downtime, power outage, water outage, gas outage, production suspension, communication disruption, or other indirect losses resulting from an accident involving the insured vehicle;
(2) Any compensation for mental damages caused by the insurance incident;
(3) Any compensation or reimbursement caused by pollution;
(4) Theft, robbery, abduction, or disappearance of the insured vehicle, as well as any damage to the vehicle or loss of parts and accessories during this period, or any injury or property damage to third parties;
(5) Other losses and expenses not within the scope of insurance liability.
P175
