Features: Filing a case is the beginning and a necessary step in a lawsuit, and all litigation activities must proceed in accordance with the law from the moment of filing. Correctly filing a case requires an accurate grasp of a series of regulations concerning the filing standards, including case acceptance and jurisdiction. In view of this, we have compiled a practical legal book series on case filing for the benefit of judicial practitioners. As one of the books in the series, "Handbook of Criminal Case Filing" has the following characteristics:
Up-to-date documents. Based on the needs of judicial practice in case filing, this book collects relevant judicial interpretations and regulatory documents from the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security that are closely related to case filing. All the documents included are the latest and effective.
Comprehensive coverage. In addition to the relevant prosecution standards, this book also includes provisions related to case acceptance and jurisdiction, as well as relevant case trial standards. It should be noted that although many judicial interpretations issued by the Supreme People's Court on the trial of certain types of cases primarily belong to case trial standards, they also contain a large number of explanations on whether such cases constitute crimes and what types of crimes they constitute. These explanations are also referred to by prosecution authorities when filing cases in judicial practice. Therefore, they are included in this book as well.
Innovative format. The book is divided into twelve parts. The comprehensive section is a compilation of general provisions on case filing work; the compilation of filing provisions for various types of crimes is arranged in the order of crimes stipulated in the Criminal Law; and the appendix includes the Criminal Procedure Law and relevant provisions on jurisdiction and case filing issued by various handling agencies in the implementation of the Criminal Procedure Law, as well as judicial interpretations on the determination of criminal law offenses.
