Features: Similar to Empirical Analysis of Civil Procedure Evidence, this manuscript remains more critical than encouraging when citing court judgments to comment on relevant theoretical issues. In fact, based on my experience and observations, the efforts and effectiveness of the court system in China are relatively commendable. Taking the Supreme People's Court as an example, compared to other departments at the same level within the system, it performs significantly better in at least two aspects:
1. Personnel Quality: The judges of the Supreme People's Court, particularly the president and section heads, may not all be considered the elite of China's legal academia or legal circles, but they all possess the necessary professional qualifications and are legal experts in their respective fields. Such professional competence and expertise are highly commendable throughout the judicial system.
2. Atmosphere Cultivation: Through years of reform, the Supreme People's Court has fostered a strong culture of diligent learning and professional dedication among its staff. Like China's administrative system, the court system also adopts a hierarchical structure, where higher courts have the authority to supervise, guide, and even overturn the judgments of lower courts under specific legal procedures. However, the legitimacy of this hierarchy is not solely based on authority; it also stems from the fact that judicial activities are highly professional. Judges in higher courts should possess higher levels of professional competence and expertise than those in lower courts. Only in this way can their guidance or rulings be truly convincing.
In this regard, high-level and high-quality standards should be the fundamental requirements for judges' appointments. However, at the current stage in China, due to various subjective and objective factors, the general high level and quality of the judiciary remain an ideal state—a goal that needs to be achieved through continuous effort. The positive atmosphere within the Supreme People's Court has created a favorable environment and conditions for reaching this goal, while also setting a good example for lower courts.
