Features: Since the revision of the Criminal Law of the People's Republic of China (hereinafter referred to as the Criminal Law) in March 1997, the Standing Committee of the National People's Congress has amended and supplemented the Criminal Law based on changing circumstances, passing the Decision of the Standing Committee of the National People's Congress on the Crime of Fraudulently Purchasing Foreign Exchange, Evading Exchange Control, and Illegally Trading in Foreign Exchange (hereinafter referred to as the Decision) and six Criminal Law amendments. Currently, dozens of articles in the Criminal Law have been amended or deleted, resulting in eight different effective dates. To facilitate judges, prosecutors, lawyers, and others in studying and applying the Criminal Law, we have compiled this Criminal Law text based on the Decision and Criminal Law amendments, incorporating practical needs in criminal case handling, and it has been reviewed and approved by the Criminal Law Office of the Legal Affairs Commission of the National People's Congress. This book employs the following legal compilation techniques:
1. "Annotations." The newly added content in the Decision is presented as annotations in Section 4 of Chapter 3 of the Criminal Law, which deals with crimes against financial management order.
2. "Notes." The amendments to the Decision and the Criminal Law amendments are directly incorporated into relevant articles of the Criminal Law, with notes in different fonts indicating additions, deletions, and effective dates of the amendments.
3. "Article Index" and "Comparison Table of Articles Before and After Amendments." An appendix provides the Index of the Main Purposes of Criminal Law Articles and Crimes and the Comparison Table of Criminal Law Articles Before and After Amendments to facilitate readers in locating articles.
This book also includes the full text of the Decision, Criminal Law amendments, legislative interpretations on criminal law, and other regulations. The new crimes listed in the Article Index are drafted by the compilers and are subject to the judicial interpretations on determining crimes announced by the Supreme People's Court and the Supreme People's Procuratorate in the future.
