Features: In the process of governing the country according to law, building a socialist country, and achieving legal modernization, it is necessary to absorb and learn from advanced legal cultural achievements from abroad. Since the 20th century, the convergence of the two legal systems has been increasingly strengthened. In recent years, the Chinese legal and judicial communities with a civil law tradition have also gradually strengthened the study and application of case law. Each case in the Case Forum Series is divided into two parts: the Preface and the Main Body. The Preface consists of the focal point of the dispute, the case background, key terms, and an overview of the case. The Main Body includes columns such as claims (accusations), case facts, key rulings, judicial interpretations, and classroom discussions. The series has three major features:
First, it has the authority of the judicial system. All the authors are senior judges. The elite judges interpret the cases they have presided over, and senior judges who participate in training comment on the cases handled by their peers. These two factors enhance the professionalism and authority of the series.
Second, it has the timeliness of judicial practice. The collection, organization, discussion, editing, and publication of cases are completed in a short period, allowing the judicial experiences of courts across the country in handling hot, difficult, and new types of cases to be rapidly promoted.
Third, it has the representativeness of applied legal research. The series is not only a reference textbook for case teaching at the National Judges College but also an invaluable resource for law schools across the country, as well as for legal practice departments such as public security, prosecution, and law firms.
This book is part of a teaching and research project. The project takes the perspective of senior judges who have received training at the National Judges College, interpreting cases and jointly commenting on them in teaching activities. It adds authoritative annotations to judgments that are obscured by formal legal language, allowing people to fully appreciate the legal logic and rational thinking behind the judgments. We believe this project will contribute to the cultivation of expert judges and learning-oriented judges, while also providing support for case studies in both the practice and theoretical communities.
This volume is the Criminal I volume.
