Compulsory Traffic Accident Liability Insurance for Motor Vehicles (hereinafter referred to as "third-party insurance") is a type of insurance that the state mandates through laws or administrative regulations, requiring owners and operators of motor vehicles to purchase insurance from insurance companies. When a traffic accident occurs, the driver's liability for personal injury or property damage to victims is borne by the insurance company. This third-party insurance system is of great significance for ensuring that victims of traffic accidents receive timely compensation and promoting road safety. Many countries and regions abroad have widely adopted this system. The "Insurance Law" stipulates that compulsory insurance must be established by laws or administrative regulations. On October 28, 2003, the Standing Committee of the National People's Congress passed the "Road Traffic Safety Law," which took effect on May 1, 2004, stipulating that the state implements the third-party insurance system, with specific measures to be formulated by the State Council. In accordance with the "Insurance Law" and the "Road Traffic Safety Law," after repeated research and revisions by relevant departments, the "Regulations on Compulsory Traffic Accident Liability Insurance for Motor Vehicles" were formulated. The main contents of the regulations include: the scope of motor vehicles participating in third-party insurance is consistent with the scope of motor vehicles stipulated in the "Road Traffic Safety Law," including automobiles, motorcycles, and tractors that are used on roads. To ensure the implementation and enforcement of the third-party insurance system, relevant departments should strengthen coordination and assume their respective responsibilities. Insurance companies, after approval by the Insurance Regulatory Commission, may engage in third-party insurance business. When necessary, the Insurance Regulatory Commission has the authority to require insurance companies to operate third-party insurance business. Without approval, no individual or entity may operate third-party insurance business. The insurance clauses and premium rates for third-party insurance must be submitted to the Insurance Regulatory Commission for approval. Third-party insurance is implemented uniformly across the country with a unified liability limit. The state establishes a Road Traffic Accident Social Assistance Fund to prepay funeral and rescue expenses for injured persons in traffic accidents.
