Features: Law is the norm for people's lives, and it should also be a tool that people can use. The new edition of the Case-Based Legal Education Series adheres to this principle and strives to achieve the following points:
1. In terms of format design, it breaks away from the practice of simply listing cases in case books and instead systematizes the relevant cases, arranging them according to the structure of each legal department, with clear logic and distinct levels.
2. In terms of content arrangement, key terms are selected from each section for explanation, ensuring a connection between theory and cases, and reference texts of legal documents are provided for readers' better understanding and application.
3. In terms of case selection, it abandons the approach of designing cases solely for specific problems and instead chooses real cases with significant impact in reality, allowing readers to experience the complexity of law in real life. Small cases, vivid and interesting, reveal the vicissitudes of life; great law, equal and just, judges right and wrong. During the writing of this book, real cases of civil litigation consulted and handled by the author were selected, and some cases with universal, typical, and representative significance were collected from practical departments and then adapted. In the analysis, we base our theories on the latest judicial interpretations of civil litigation and academic research achievements, following the content and format of the current Civil Procedure Law and authoritative textbooks on civil litigation law. Through case analysis, we explain in an accessible manner the key points and difficult issues of civil litigation law, balancing the practicality and theoretical nature of case reviews. It should be noted that since evidence law and enforcement law will be written separately, this book does not include the parts on evidence and enforcement.
This book is divided into several sections according to case categories. At the beginning of each section, 2 to 5 terms are explained to help readers understand the professional terms that appear in the later case analyses; the main body consists of a certain number of cases, including case introductions, trial results, different perspectives, and analyses, along with a certain amount of reference texts.
