Author: Research Office of the Supreme People's Court
Publisher:
Publishing Date: 2006-03-01
Features: This book strives to highlight the following two characteristics:
1. Emphasizing the comprehensive collection of relevant materials. Previously edited and published similar books often focused only on collecting judicial interpretations, without fully collecting interpretive documents and judicial work normative documents, or although they did collect them, they were not complete, making it difficult for readers to understand the full picture of judicial documents from the Supreme People's Court. Considering that interpretive documents and judicial work normative documents also play an important guiding and reference role in judicial practice, we have included them in the editing of this book.
2. Paying attention to the explanation and elaboration of relevant materials. In recent years, the number of legal application issues involved in judicial practice has been increasing, and judicial interpretations have been receiving more attention. The relevant departments and all sectors of society have also called for the Supreme People's Court to strengthen its judicial interpretation work. To help courts at all levels and readers accurately grasp the content of judicial interpretations, articles explaining and elaborating on the background and process of drafting the judicial interpretation, its basic content, the matters it addresses, and the relevant policy and legal boundaries are usually published in relevant newspapers and periodicals by judges who specifically drafted the judicial interpretation. According to our understanding, these articles serve as useful reference materials for studying and researching judicial interpretations, which will benefit readers. In 2005, the Supreme People's Court issued 15 judicial interpretations and 32 interpretive documents and judicial work normative documents. Among these judicial interpretations, there are several of great significance, such as "The Supreme People's Court on the Application of Laws in Cases Involving Contract Disputes over State-owned Land Use Rights" and "The Supreme People's Court on Several Issues Concerning Credit Letter Disputes." Providing readers, especially legal professionals, with relevant authoritative reference materials in a timely manner will help them fully understand these judicial interpretations.
