Publish Date: 2006-03-24
Features: This book strives to highlight the following two characteristics:
1. Emphasizing the comprehensive collection of relevant materials. Previously published similar books often focused only on collecting judicial interpretations, without fully collecting judicial interpretive documents and normative documents on judicial work. Even when collected, they were often incomplete, making it difficult for readers to understand the full picture of judicial documents from the Supreme People's Court. Considering that judicial interpretive documents and normative documents on judicial work also play an important guiding and reference role in judicial practice, we have included them in this book during the editing process.
2. Paying attention to the explanation and interpretation of relevant materials. In recent years, legal application issues have become increasingly prominent in judicial practice, and judicial interpretations have garnered growing attention. Relevant departments and society at large have called for the Supreme People's Court to strengthen its judicial interpretation work. To help courts at all levels and readers accurately grasp the content of judicial interpretations, articles written by judges who drafted specific judicial interpretations are often published in relevant newspapers and magazines simultaneously with the release and implementation of the judicial interpretations. These articles explain and interpret the background and process of drafting the judicial interpretations, their basic content, the matters they address, and the relevant policy and legal boundaries. According to our understanding, these interpretive references are helpful in enhancing the guiding role of judicial interpretations. Therefore, this book also includes these articles as reference materials for studying and researching judicial interpretations, which we believe will benefit readers. In 2005, the Supreme People's Court issued 15 judicial interpretations and 32 judicial interpretive documents and normative documents on judicial work. Among these judicial interpretations, some are of great significance, such as "The Supreme People's Court on the Application of Laws in Cases Involving Contract Disputes over State-owned Land Use Rights" and "The Supreme People's Court on Several Issues Concerning Disputes over Letters of Credit." Providing readers, especially legal professionals, with relevant authoritative reference materials in a timely manner will help them fully understand these judicial interpretations.
