Features: In recent years, with the rapid development of the economy and society and the deepening of legal construction, the adjudication work of courts in our province has made significant progress. Annually, courts across the province handle hundreds of thousands of cases. Among them, some are difficult or new types of cases, which hold reference and learning value for adjudication work; others contain profound value judgments in their judgments, playing a role in regulating and guiding public thought and behavior. Therefore, it is necessary to regularly and systematically select and compile adjudication cases from courts across the province to promptly reflect the status and level of adjudication work in our province, summarize and exchange experiences, guide adjudication practice, strengthen legal publicity, and expand the effectiveness of adjudication. At the same time, it also provides valuable reference materials for judicial workers, teaching and research personnel.
To this end, the Party Committee of the Anhui High People's Court decided to compile an annual selection of adjudication cases from courts across the province starting from 2004, as an important part of strengthening professional development. Anhui Court Case Selection 2004 is a collection of typical cases selected from hundreds of thousands of enforceable judgments made by courts across the province in 2004, covering a wide range and diverse types. The case selection inherits the characteristics of authenticity, comprehensiveness, timeliness, and reasoning from Anhui Court Case Selection (2003 Volume) while further improving its format. It includes the adjudicating bodies at various levels, parties involved in the lawsuit, time of case resolution, claims and determinations of both sides, identified facts of the case, evidence adopted, and applicable legal provisions. It is hoped that this will help readers gain a comprehensive understanding of the adjudication process of the cases.
