The fourth paper of the judicial examination is the one with the lowest average score in the history of the judicial examination (law examination), and it is also the one that makes the vast majority of candidates feel clueless. Statistics show that the average score of the fourth paper in previous years was only around 40 points. In the judicial examinations of 2004 and 2005, the average score of the fourth paper, with a total score of 150 points, was also only over 60 points. What is the direction of the case-setting for case questions, how should they be reviewed, and how should they be answered? These often leave many candidates baffled. Due to the inability to break through these difficulties, some candidates even develop a fear of case questions at the mere sight of them and become confused when faced with case papers. In response to the various misunderstandings of candidates regarding case questions, we believe it is necessary to clarify the following points:
First, in terms of question-setting logic, case questions do not seek to be strange or novel; the cases they contain are concentrated reflections of specific legal disputes in real life. Second, in terms of knowledge distribution, case questions do not seek to be biased or deep; their key points are usually important knowledge points of each legal department. This is first reflected in the distribution of the number of case questions for each legal department, which is characterized by the prominent status of important legal departments. Third, in terms of question-setting methods, case questions are increasingly comprehensive.
Fourth, in response to the above characteristics of case questions, during preparation, candidates should strengthen their macro understanding and in-depth analysis of the relevant legal provisions and systems of each legal department, truly grasping their essence to adapt to the emphasis on comprehensive application, flexibility, and practicality in case questions. Based on the above characteristics of case questions in the judicial examination, we have written this book with the aim of helping candidates achieve significant progress in terms of logic, methods, and techniques, and to achieve a breakthrough in high scores. The features of this book are as follows:
