Features:To coincide with the promulgation and implementation of the Uniform Contract Law, we have gathered a group of peers with years of experience in teaching, researching, legislating, and working in the economic courts of the courts to compile this New Contract Collection of the People's Republic of China.
The basic guiding principles for the editorial review are: to highlight practicality while ensuring practicality, and to balance knowledge and theory.
The book is divided into four volumes.
Volume 1: "Basic Principles" is divided into two parts—General Principles and Specific Regulations. It is based on the system and specific provisions of the Uniform Contract Law, but also breaks new ground by discussing contracts that exist in reality but are not included in the law.
The second volume, "Case Studies and Analysis," is organized primarily according to the system of the Uniform Contract Law General Principles. In the analysis, cases that align with the content of the previous three contract laws and the newly promulgated contract law are evaluated based on those content as legal grounds. Cases with new provisions under the new contract law, such as those involving changes in circumstances, pre-contractual obligations, the right of subrogation, or the right of revocation, are pointed out to show how the new contract law addresses these issues, ensuring the guidance of the cases.
Volumes three and four are respectively "Laws and Regulations" and "Document Formats." From the vast array of laws, regulations, judicial interpretations, and different versions of document formats related to contracts, the most closely connected with contract practice are selected and presented to readers.
