Features: The 2005 Judicial Examination has concluded. Compared to the previous three judicial examinations, this one has shown significant changes in both objective and subjective questions. To provide reference and guidance for the 2005 Judicial Examination preparation, after careful organization, planning, and repeated analysis, we have revised and republished this book for the readers. This book has the following characteristics:
1. Focusing on Practice with Past Exam Questions: Past exam questions are a treasure trove for candidates preparing for the Judicial Examination, as they play a crucial role in guiding future exam trends. They reflect past exam directions, key points, and patterns, while also objectively indicating future trends. Statistics show that fundamental knowledge points repeatedly tested in each department of law account for over 80% of the annual exam content. Studying past exam questions is essentially preparing for future exams. Although the Judicial Examination covers a broad range and extensive content, its focus is very clear—emphasizing the mastery of fundamental knowledge points in each department of law, which are best reflected in past exam questions. This book, based on the question types of the Judicial Examination, uses past exam questions as the main thread to provide in-depth analysis and solutions, helping candidates deepen their understanding of fundamental knowledge points through practice, making the learning process highly efficient and practical.
2. Comprehensive Integration to Enhance Study Efficiency: In practice, we have observed that some candidates, despite solving past exam questions multiple times, do not achieve satisfactory results, while others, who have only solved a few, perform outstandingly. The reason for this stark contrast lies in the former’s mechanical repetition without analysis or insight, leading to low efficiency, whereas the latter’s thoughtful approach and analysis yield high efficiency. However, achieving a comprehensive understanding of past exam questions is not easy, as it requires a solid legal foundation and significant time and effort to consult extensive relevant materials. The purpose of this book is to help candidates complete this task efficiently in the shortest time possible, enabling them to integrate past exam content and master the knowledge points, thereby maximizing study efficiency.
3. Detailed Analysis to Strengthen Exam Skills: To help candidates achieve effective review within limited time, this book introduces significant innovations in its structure: First, at the beginning of each department of law, a brief statistical summary of the value distribution of the Judicial Examination (Lawyer Qualification Examination) over the past five years is provided, along with an insightful analysis of the fundamental patterns and review techniques of the department, allowing candidates to gain a comprehensive understanding of the overall department before starting their review, ensuring confidence. Second, the main text is organized based on the internal logic of each department of law, referencing past textbooks and current regulations. It first introduces the objective questions of each department of law. Under each key point, multiple-choice questions, multiple-choice questions, and uncertain-choice questions are presented in sequence (with sub-items arranged in chronological order from 2005, 2004, 2003, 2002, 2000, and 1999). The subjective questions, such as case analysis and argumentative essays, are not separately chaptered but are comprehensively analyzed. Each specific question is analyzed in four parts: answer, key point, explanation, and difficulty level.
- Answer: The answers are comprehensive and precise. To clarify the confusion surrounding past exam answers, we have set high standards and strict requirements for determining answers, ensuring they pass three review stages: individual preliminary review by the author, group review by the writing team, and final review by the chief editor.
- Key Point: This section is designed to help candidates grasp fundamental knowledge points, understand common exam topics, identify key areas, and clarify their review direction.
- Explanation: This is the core of the book, aiming not only to let candidates know what but also why. Unlike traditional books that simply explain legal provisions, this book delves into the intent of the question setters, the value orientation and legislative purpose of legal provisions, providing thorough and persuasive analysis. Additionally, we emphasize the summarization and comparison of legal provisions, as well as the connection and differentiation of related knowledge, to help candidates use past exam questions dynamically.
- Difficulty Level: This is an innovation in our book. The difficulty level is designed to provide candidates with an objective measure to assess their learning progress and review effectiveness. A difficulty level of “” means candidates should master the question after one attempt; if not, it indicates a weak foundation in basic knowledge. A difficulty level of “” means candidates should have mastered the question by one month before the exam; failure to do so suggests increased review intensity is needed. A difficulty level of “” means candidates should strive to overcome it in the final review; failure to do so may make it difficult to achieve high scores in the exam. Generally, if all questions with a difficulty level of “” are mastered, passing the exam should not be a problem.
Furthermore, after each key point or section, we have compiled a summary of tested key points and legal provisions, along with preparation tips, providing concise guidance to help candidates after they complete each key point or section.
Most of the authors of this book have studied and tutored the Judicial Examination (Lawyer Qualification Examination) for many years. They are legal scholars from the Supreme People’s Court, China University of Political Science and Law, and Renmin University of China, all of whom have passed the national Judicial Examination with high scores. The combination of solid theoretical foundations and extensive practical experience is the greatest strength of the authors. This book was completed through the dedicated research and collaboration of all the authors, with the final editing and compilation by the chief editor. Due to the relatively short history of China’s national Judicial Examination and the haste in writing, any shortcomings are kindly noted and appreciated by experts and candidates alike.
