1. With the establishment of the principle of a socialist rule of law state and the development of a socialist market economy system, more and more social and economic relationships require the use of legal means for regulation. In light of this, we have organized experts and scholars from the Supreme People's Court, relevant ministries and commissions of the State Council, and universities to compile this series, "Common Legal Decomposition and Application Integration." This series breaks away from the traditional listing format of legal compendia and adopts a classified compilation method. It takes commonly used laws as the main framework and decomposes and combines them into several specific legal issues based on the logical connections between legal provisions. Itly arranges all relevant laws, regulations, departmental rules, judicial interpretations, and legislative explanations related to each issue, enabling readers to quickly and comprehensively find all specific legal provisions related to the issue. In this way, the complex and vast legal provisions are organized into an interconnected, coherent, and conveniently applicable whole.
2. "The Legal Decomposition and Application Integration for Punishing Torture and Dereliction of Duty Crimes" takes the "Criminal Law of the People's Republic of China" and the "Criminal Procedure Law of the People's Republic of China," as well as the latest judicial interpretations from the Supreme People's Court and the Supreme People's Procuratorate, as the warp, and the specific provisions of relevant laws, regulations, and administrative rules as the weft, to conduct a comprehensive and systematic decomposition and application integration. The book is divided into five chapters and 48 categories: General Provisions, Subjects of Torture and Dereliction of Duty Crimes, Punishment of Torture and Dereliction of Duty Crimes, Punishment of Torture and Dereliction of Duty Crimes by Public Officials, and Case Filing and Investigation of Torture and Dereliction of Duty Crimes.
3. The relevant laws, regulations, and departmental rules included in this book are adopted in full or excerpted depending on the specific circumstances. When multiple issues involve the same document (or the same legal provision), they are appropriately repeated for the sake of reducing inconvenience in searching and reviewing, categorized by their respective issues. Documents that are not suitable for decomposition are arranged together with the more major issues they concern, while less major issues are referenced using the phrase "see."
4. The arrangement of this book has been designed to minimize repetition and facilitate easy reference, but due to the limitations of the compilers, there may be various omissions. We sincerely welcome criticism and corrections from readers. "With this 'Integration' in hand, there is no need for anything else" is the guiding principle of this book's compilation. We hope it can become a valuable legal reference tool for readers, serving as a trusted guide and friend for convenient and accurate legal application.
