Features: The manuscripts included in the fifth volume of the "Intellectual Property Series" were finalized by the end of 2000. Although some of the materials may have seemed outdated to some extent, each manuscript embodies the authors' dedicated research and conscientious work, and thus its value is not affected by the mere passage of a few months. We once thought that by the time this book was published, China would have become a member of the World Trade Organization, and some of the statements might have become "hindsight," but when I rewrote this preface just before it went to print, I found that the steps to join the WTO had once again stalled. This volume includes two lengthy essays in the field of trademark law. Dr. Huang Hui's essay "Legal Protection of Trademark Identification and Appellation Functions" is part of his graduation thesis, focusing on cutting-edge theoretical issues in the recognition of well-known trademarks and their protection. Some of the concepts of French tort law discussed in the essay are worth attention and reference when studying issues in various fields of intellectual property protection. In fact, both aspects have been plagued by various misunderstandings in past research. As the saying goes, "Without understanding the situation, both leniency and strictness will be in error," scholars should be cautious in their studies. The essay "Research on the Conflict of Trademark Rights, Design Patent Rights, and Copyright" by Jin Duocai et al. is a result of a national social science fund project, which conducts specialized research on the protection issues of three potentially conflicting intellectual property rights, solving many problems that have long confused people, and is worth readers' attention.
