United States Case Law Interpretations of the Uniform Commercial Code

Author: Lin Xiaoyun

Publish Date: 2003-06-01
Features: With nearly a decade of experience in commercial litigation in the United States, the author deeply understands the difficulties faced by domestic enterprises in import and export trade with the U.S. due to their lack of familiarity with U.S. laws and business practices. This has led to issues such as unpaid debts, receiving substandard products, being deceived, accumulating bad debts, and resulting in business losses. The author wishes to take this opportunity to introduce and analyze some cases from U.S. courts in this regard, exploring how to take appropriate measures to avoid being cheated or involved in disputes, or, when disputes arise, how to win the case with reason and minimize or avoid unnecessary litigation burdens and expenses. The other purpose of this book is to provide domestic colleagues engaged in commercial law research with some reference materials on U.S. commercial law cases. "A stone from a distant hill can be used to polish jade." In recent years, many books on this topic have been published domestically, but most focus on theory and lack close ties to the practical aspects of import and export trade. In reality, when discussing the practical aspects of import and export trade, whether it is drafting and concluding contracts or fulfilling and enforcing contracts, the fundamental goal is to avoid disputes and win lawsuits. Therefore, discussions on these topics should naturally revolve around how to avoid disputes and win lawsuits.
