The real estate industry in China is still relatively new, having developed since the early 1990s and only having a history of about a dozen years. Like other industries, its development has gone through a process from immaturity to gradual maturity. Currently, China's real estate industry is in the process of transitioning toward maturity. As the industry continues to develop, the laws and regulations governing real estate in China are gradually being improved and refined. The Urban Real Estate Administration Law of the People's Republic of China, passed by the Standing Committee of the Eighth National People's Congress on July 5, 1994, is one of China's key laws related to urban real estate management. Subsequently, on July 20, 1998, the State Council issued the Regulations on the Administration of Urban Real Estate Development and Operation. Based on these laws and regulations, the Ministry of Housing and Urban-Rural Development and local real estate authorities have also issued a series of departmental rules and regulatory documents. However, overall, China's current real estate laws and regulations are not as well-established as those in developed countries.
Therefore, due to the current lack of comprehensive real estate laws in China, but to better address the vast number of real estate legal issues arising in practice, there is a need for more research and discussion in theory, with the aim of finding practical solutions. As lawyers, compared to other legal professions, we are at the forefront of legal practice, whether in non-litigation matters, litigation or arbitration after disputes arise, or in national or local legislation, as well as the issuance of government regulatory documents—all of these activities involve the participation of a large number of lawyers. It can be said that with the acceleration of China's rule-of-law process and the increasing legal awareness of the government and the public, lawyers' work now touches every aspect of society, and the real estate sector is no exception.
Additionally, with the development of the legal profession over the past dozen years, real estate legal services have become one of the main areas of practice for lawyers. Due to the large number of lawyers involved in real estate legal matters, more and more lawyers are engaging in the study of real estate law.
