Features: The assertion that "a sound legal system is the cornerstone of modern social civilization" has not only been proven by the historical development of human society but has also become increasingly recognized as a common consensus. Throughout human history, examples of establishing a comprehensive legal system and promoting social development and civilized progress through the rule of law can be found everywhere. However, if one flips through the history of all nations and civilizations across the East and West, it is extremely difficult to find cases where a country could thrive and society could progress without a legal system.
Building on a systematic analysis and drawing on the theories of legal behavior and legislative achievements from both China and the world, and linking them with China's judicial practices, this book conducts a relatively comprehensive, in-depth, and creative study and exploration of the scope of application of legal behavior systems, the value of the principle of autonomy, the concept of legal behavior, the basic rules of legal behavior systems, the principles of expression of intent, and the issues of mandatory laws and presumed laws in the control of legal behavior. The themes discussed in this book involve some of the most important and challenging issues in the civil law theory of the. The arguments presented in the book are characterized by depth and research rigor, with many of the views being first introduced in domestic theoretical research.
