Taxation is a primary source of national fiscal revenue and an important economic lever for macro-control. It is inseparable from the rule of law, and the rule of law in taxation is a crucial component of the rule of law in governance, serving as the foundation and soul of taxation work. It is also a fundamental requirement for establishing and developing a socialist market economy system and building a harmonious society.
Modern market economies and democratic politics are shared treasures of human civilization. Currently, countries worldwide, especially those with developed market economies, strongly emphasize and prioritize the rule of law in taxation and tax audits. Tax inspections hold a prominent position in the tax management process and have achieved numerous successful experiences in tax legislation, law enforcement, and judicial aspects. For example, tax legislation is well-developed, the tax legal system is sound, tax enforcement is strict, tax administration mechanisms are refined, tax judicial safeguards are robust, with the establishment of tax police and tax courts, and a favorable tax enforcement environment that prioritizes protecting the legitimate rights of taxpayers.
Since the reform and opening-up in China, especially following tax system reforms, tax administration reforms, and tax agency reforms, the rule of law in taxation has also made significant progress. The main achievements include:
First, progress has been made in tax legislation, and the basic framework of the tax legal system has been preliminarily established.
Second, tax enforcement has gradually moved toward legalization and standardization, strengthening the rigor and stiffness of tax laws.
Third, the coordinated operational capacity of judicial authorities and tax agencies in combating tax crimes has been enhanced, with a number of major and significant tax-related cases being legally handled.
Fourth, the tax enforcement environment has improved, with more people showing concern and support for tax work, and the concept of the rule of law in taxation is becoming increasingly deeply rooted in society. Among these, tax inspection has always been one of the hot topics of public concern.
The role of tax inspections in China's tax management has become increasingly evident. Currently, many universities offer tax inspection courses in finance, taxation, and related disciplines. The purpose of this course is to enable students to master a wide range of tax inspection methods and techniques. Through case-based teaching in educational reforms, students can deepen their understanding of tax inspection theories and methods, improve their practical skills, conduct independent inspections of enterprises, and analyze key areas and potential problem points for each tax type to achieve positive results.
To meet the needs of tax inspection course teaching, we have compiled this textbook, "Tax Inspection Case Studies," as a supplementary material for "Tax Inspection." During the writing process, we followed the principles of "selecting high-quality content, strengthening practice, cultivating skills, and emphasizing application," striving for distinctive education with a focus on ability development, reflecting targeting, practicality, and advancement.
This book focuses on practice, based on tax policies and laws, and is organized according to the accounting procedures of taxpayers. It provides in-depth analysis of 158 tax inspection cases across 15 current tax types, including Value-Added Tax, Consumption Tax, Business Tax, Urban Maintenance and Construction Tax, Customs Duty, Resource Tax, Land Value-Added Tax, Urban Land Use Tax, Property Tax, Vehicle and Vessel Use Tax, Stamp Duty, Deed Tax, Corporate Income Tax, Foreign-Invested Enterprises and Foreign Enterprises Income Tax, and Individual Income Tax. Each case is accompanied by analysis and commentary, as well as appendices (background materials), to help readers learn by example and continuously improve their tax inspection and tax practice skills.
This book serves as a reference book for teaching and research in higher financial and economic universities for finance and taxation majors as well as for economic management majors.
