Features: This book has undergone significant revisions based on the previous edition, incorporating more fundamental theoretical content. In addition to introducing basic economic law, it also covers relevant civil and commercial law fundamentals. It primarily includes basic concepts of economic law, civil law, and commercial law, fundamental theories of civil law, corporate law, financial law, and relevant legal systems of economic law and the WTO. It is one of the designated textbooks for the postgraduate entrance examinations in economic law and civil/commercial law at our university. Besides introducing some basic content of economic law, this book also presents corresponding civil and commercial law fundamentals. The reason for adopting this approach is mainly based on the following factors:
1. The development of the socialist market economy requires college students to master basic legal knowledge for regulating socio-economic relationships.
2. The fundamental principles of civil law are not only essential for understanding commercial law but also for grasping economic law.
3. Previous economic law textbooks often confused commercial law with economic law, treating legal systems such as corporate law, bankruptcy law, and negotiable instruments—belonging to the realm of commercial law—as part of economic law. This approach hindered students from accurately and deeply understanding the essence and characteristics of such laws.
4. Due to these teaching misconceptions in economic law, coupled with the imperfections and outdated theories of economic and commercial law in China, economic law teaching often focused on specific provisions, inadvertently neglecting the underlying fundamental theories. In light of this, the book has undergone significant changes in both content and structure, incorporating more fundamental theoretical content to emphasize the importance of teaching the legal foundations for regulating socio-economic relationships. The goal is to avoid the outdated practice of merely giving students a key while neglecting to teach them how to use it.
