Features: This book is compiled based on the format of Professor Huang Jin's Private International Law (published by Law Press in 1999), aiming to provide a comprehensive and systematic reference for the teaching and research of private international law in China, with the hope of promoting the development of the discipline in our country. The selected materials extensively draw from legislation, case law, and scholarly opinions both domestically and internationally, arranged in both Chinese and English, forming a self-contained system with distinct characteristics. Specifically, the following aspects are highlighted:
First, in terms of format, it breaks away from the traditional model of categorizing regulations and cases separately. Under each chapter, the book systematically compiles the opinions of renowned domestic and international scholars, relevant legislation and treaties of various countries, typical cases, as well as indexes of papers and works. This allows readers to locate the desired materials relatively easily and comprehensively understand related issues.
Second, in the collection of materials, due to the current demand for bilingual teaching, the compilers directly use English sources when collecting and organizing the opinions of foreign scholars, international treaties, and other materials, provided that the original English versions are available.
Third, during the organization of materials, the compilers conducted thorough comparisons for some of the translated content, particularly regarding foreign legislation and international treaties. First, they ensured the freshness of the materials; second, when using Chinese translations, they strived to maintain the authority and accuracy of the translations. For many regulations and treaties, the compilers invested significant time in revising and translating them.
Fourth, to reflect the progress of private international law research in China, this book preliminarily organizes and lists domestic papers and works on private international law from 1980 to 2002 as "Appendices" after each chapter, facilitating further in-depth research for readers. Additionally, for ease of reference and conciseness, the book includes a General Index, a Detailed Index, an Abbreviated Index of Cited Literature, and an Abbreviated Index of Legislation or Model Laws of Various Countries. Readers can use the General Index to locate relevant content, the Detailed Index to find the page numbers of desired materials, and then follow the page number references to access the specific materials. It is worth noting that all individual scholars' opinions, different legislative acts, and cases are listed one by one in the Detailed Index.
When using this book, readers should pay special attention to the following points:
1. The book uses an "Abbreviated Index of Cited Literature," which shortens the names of works and materials into abbreviations or simpler designations. Readers can use this index to find the full bibliographic information.
2. The book employs an "Abbreviated Index of Legislation or Model Laws of Various Countries," which simplifies the international private law legislation of each country to the names of the respective countries. Readers can use this index to locate the full titles of the laws.
3. The materials cited in the book are as faithful to the original texts as possible. If obvious errors are found in the original texts, additional content is added in parentheses, marked with "Editor's Note."
4. For technical layout reasons, the book renumbers the footnote references in the quoted original texts but makes minimal changes to the content of the notes themselves.
