The State Compensation Law refers to the general term for legal norms concerning the state's liability for tort compensation. The State Compensation Law affirms state responsibility, and its spiritual value is immeasurable. It for the first time treats the state and citizens equally, no longer granting the state privileges. When the state violates the law, it must also bear compensation liability; for victims, when their legitimate rights and interests are infringed upon, they have the right to receive compensation. It can be said that the State Compensation Law pursues a deeper level of rule of law and social fairness and justice.
On May 12, 1994, the Standing Committee of the Eighth National People's Congress adopted the State Compensation Law of the People's Republic of China. This code is a major component of China's state compensation law regulations, providing comprehensive provisions on the subjects of state compensation, principles of liability, scope, procedures, and methods. It serves as the fundamental source of the state compensation system.
