Since 1949, China's civil code drafting efforts have been interrupted several times, and to this day, no civil code has been enacted. However, China does not lack basic civil legal norms. On the contrary, the establishment of basic civil legal norms in China has a history of nearly two decades. These ten years have been a period of intense social transformation in Chinese society. In such a social environment, the establishment and development of a reasonable and stable legal order for private life, as well as the transformation of Chinese society, have been instrumental.
The institutional background for drafting the General Principles of Civil Law was the existence of contradictions and inconsistencies among the numerous single regulations at the time, creating an urgent need for a basic civil law. Therefore, the General Principles of Civil Law stipulated the objects of regulation, basic principles, civil subjects, civil acts, civil rights, and civil liabilities of civil law, establishing a preliminary framework for China's civil law system and solidifying its status as the fundamental civil law of the country.
The birth of the General Principles of Civil Law filled the void in China's basic civil law, providing foundational legal rules for the market economy and private social life, while also promoting the modernization process of China's legal system construction.
