Features: As the administrative department for patents under the State Council, the National Intellectual Property Administration entrusts the National Intellectual Property Administration Patent Office to accept and examine patent applications. The Patent Office makes various decisions on behalf of the National Intellectual Property Administration. To handle relevant applications and requests objectively, fairly, accurately, and promptly in accordance with the law, the National Intellectual Property Administration formulated this Patent Examination Guide based on Article 121 of the Detailed Rules of the Patent Law. This guide is the specific implementation of the Patent Law and its Detailed Rules, and therefore serves as the legal basis for the administration and standards of the Patent Office and the Patent Reexamination Board. It is also the regulations that relevant parties must comply with at the respective stages mentioned above. This guide was revised based on the 1993 edition of the Examination Guide in accordance with practical working needs and is issued as a departmental regulation of the National Intellectual Property Administration.
