Features: To change this situation and ensure the correct implementation of the "State Compensation Law." In 2001, the Supreme People's Court explicitly stated in the "Provisions on Handling Cases Involving Objections to the Court's Valid Judgments" that the Supervisory Trial Tribunal is responsible for state compensation confirmation cases. After accepting this task, the Supervisory Trial Tribunal of the Supreme People's Court regarded the formulation of judicial interpretations as the top priority in carrying out state compensation confirmation work. To facilitate judges across the country who are responsible for hearing state compensation confirmation cases to better understand and master the "Provisions," we organized relevant colleagues to write this book. This book is divided into four parts:
Part I: Colleagues from the drafting group of the "Provisions" interpret the content of the judicial interpretation article by article, combining with the issues encountered during the formulation process, and provide corresponding explanations for the document formats.
Part II: To further help readers understand and master the spirit of the judicial interpretation, we selected issues closely related to the judicial interpretation, such as compensation and enforcement, and invited Ji Min, Zhang Xinmin, Wang Feihong, Zhao Jingshan, Su Ge, and Zuo Hong to write about their understanding and application of the judicial interpretation and related issues.
Part III: Considering that the work of hearing state compensation confirmation cases has not been carried out for a long time and is still a brand-new task for many courts, we have included cases of state compensation confirmation that the Supreme People's Court has already heard. These cases reflect the specific application of the provisions of the judicial interpretation from different perspectives, providing readers with a certain intuitive understanding of the judicial interpretation.
Part IV: This part comprehensively collects laws, regulations, and judicial interpretations related to the hearing of state compensation confirmation cases. During the writing of this book, we have always adhered to the principle of combining theory with practice, with the hope that this book will be helpful to colleagues working in the field of state compensation confirmation adjudication.
