Criminal Source Theory

Publish Date: 2005-03-01
Features: This book discusses strategies for crime governance. The overall content of the book can be summarized as research on three levels of issues, which can also be referred to as the "Three Theories":
1. Criminal Discipline Theory. The author combines "source" and "flow" for study, reflecting his idea of criminal integration. While each criminal discipline is indeed an independent field with its own distinct research objects, methods, and functional roles, they also form a closely related discipline group with strong interdependence, interconnection, and interaction.
2. Criminal Source Theory. The core of this book is the study of the crime source, i.e., research on finding root solutions. In other words, it is also the study of the source of criminality. The book points out that research on crime prevention and reduction starting from systems has been limited so far, and the study of source issues lacks depth, breadth, and intensity. The era of truly studying crimes from the source and practicing crime prevention and reduction has not yet arrived. However, we should start from the existing actual conditions.
3. Criminal Flow Theory. The author divides the study of the entire crime issue into the study of the crime source and the study of the crime flow. In terms of the division of discipline territory in criminal studies, the author believes that the discipline territory of criminology lies at the source, while other disciplines are located in the flow. Regarding sentencing issues, the author starts from the causes of crime and proposes examining social harm from a full process of "gene source - behavioral outcome - post-attitude" to determine the appropriate level of punishment within the overall criminal policy. In specific sentencing issues, detailed sentencing guidelines should be studied based on the current criminal law provisions to guide practical sentencing operations. At the same time, from the perspective of criminal law application, the author theoretically proposes the establishment of applied criminal law.
