Features: The 2004 Judicial Examination has concluded. Compared to the previous two judicial examinations, this one has shown significant changes in both objective and subjective questions. To provide reference and guidance for the 2005 Judicial Examination, after careful organization, planning, and repeated analysis, we have revised and republished this book for the benefit of all readers. The book has the following characteristics:
1. Focusing on Past Exam Questions to Emphasize Practical Application
Past exam questions are a treasure trove for candidates preparing for the Judicial Examination, as they play a crucial role in guiding future exams. They reflect past examination trends, key areas, and patterns, while also objectively indicating future directions. Statistics show that fundamental knowledge points frequently tested in each subject account for over 80% of the annual examination content. Studying past questions is essentially preparing for future ones. Although the Judicial Examination covers a broad range and extensive content, its focus is clear—emphasizing the mastery of fundamental knowledge points in each subject. Past exam questions are the reflection of these key points. This book, based on the question types of the Judicial Examination, uses past questions as the main thread to provide in-depth analysis and solutions, helping candidates deepen their understanding of fundamental knowledge points and highlight practical application.
2. Integrating Knowledge to Enhance Study Efficiency
In practice, we have observed that some candidates, despite immersing themselves in a sea of questions, achieve poor results, while others, by only studying past exam questions, achieve satisfactory outcomes. The reason for this stark contrast lies in the former’s mechanical repetition without analysis or insight, wasting time and effort with little return. The latter, however, thinks critically and analyzes questions, achieving success with efficiency. Yet, to analyze and master past questions comprehensively is not easy—it requires a solid legal foundation and significant time and effort to consult numerous relevant books. The purpose of this book is to help candidates complete this task efficiently in the shortest time possible, thereby improving study efficiency.
3. In-Depth Analysis of Past Questions to Strengthen Exam Skills
To help candidates achieve effective study goals within limited time, this book introduces significant innovations in its structure:
- First, at the beginning of each subject, a brief statistical summary of the scoring distribution over the past five years of the Judicial Examination (Lawyer Qualification Examination) is provided. Based on the latest developments in the exam, the book offers concise analysis of the fundamental patterns and study techniques for each subject, allowing candidates to gain a comprehensive understanding of the subject as a whole before starting their study and practice, ensuring confidence.
- Second, the main body of the book is organized according to the internal logic of each subject, referencing past textbooks and current regulations. It first introduces the objective questions of each subject. Under each key point, multiple-choice questions (single, multiple, and uncertain options) are presented in the order of 2004, 2003, 2002, 2000, and 1999. Case analysis questions and essay questions in the subjective section are analyzed in detail. The analysis of each specific question is divided into four parts: Answer, Key Point, Explanation, and Difficulty Level.
- Third, Answer is precise and comprehensive. To clarify the confusion surrounding past exam answers, we provide clear and scientific guidance. In compiling this book, we not only referenced extensive literature but also ensured high standards and strict requirements for determining answers. The answers must pass three stages: personal review by the author, review by the writing team, and final approval by the editor-in-chief.
- Fourth, the Key Point section is designed to help candidates master fundamental knowledge, understand common exam areas, grasp key points, and clarify study directions.
- Fifth, the Explanation section is the core of the book, aiming to help candidates not only understand what is correct but also why it is correct. Instead of relying on traditional methods that simply explain legal provisions, we delve into the intent of the question setters, the value orientation and legislative purposes behind legal provisions, providing thorough and persuasive analysis. At the same time, we emphasize the summarization and comparison of legal provisions, as well as the connection and differentiation of related knowledge, to help candidates use past questions effectively.
- Sixth, Difficulty Level is an innovation. The purpose of using difficulty levels is to provide candidates with an objective measure to assess their learning progress and study effectiveness. A difficulty level of \ means the candidate should master the question after one attempt; if not, it indicates a weak foundation in basic knowledge. A difficulty level of \\ means the candidate should have mastered the question by one month before the exam; if not, it suggests the need for increased study intensity. A difficulty level of \\\ means the candidate should strive to overcome it in the final review; failure to do so may make it difficult to achieve high scores in the exam. Generally, if all questions with a difficulty level of \\ are mastered, passing the exam should not be a problem. Additionally, after each key point or section, we have compiled a summary of tested key points and legal provisions, along with study tips, to provide guidance and reminders for candidates after completing each section.
The authors of this book have extensively studied and coached for the Judicial Examination (Lawyer Qualification Examination) for many years. They are legal scholars from the Supreme People’s Court, China University of Political Science and Law, and Renmin University of China, all of whom have passed the national Judicial Examination with high scores. The combination of solid theoretical foundations and rich practical experience is the greatest strength of the authors. This book was completed through the dedicated research and collaboration of all authors, with the final editing and compilation by the editor-in-chief. Due to the relatively short history of China’s national Judicial Examination and the haste in writing, any shortcomings are sincerely hoped to be pointed out by experts and candidates.
