Publish Date: 2004-06-01
Features: This book proposes and systematically explores the concept, category, and theory of labor rights, using this as a theoretical framework to study and analyze related issues such as the state, characteristics, essence, and trends of legal regulation in China's labor relations. The book argues that the social labor problems arising during China's transition to a market economy are, in essence, laborer issues, and more fundamentally, issues of labor rights. From the perspective of laborer human rights and laborer dignity, the book proposes and demonstrates that the essential feature of labor law is the protection of labor rights, and that the basic requirement of legal regulation in labor relations should be the protection of labor rights. It advocates for reconstructing the theoretical system of labor law in China's market economy and improving the mechanisms for regulating labor relations based on the principle of labor rights. Guided by this philosophy, the book systematically analyzes and argues the legislative and implementation status of individual and collective labor rights, as well as the improvement and development trends of labor laws, based on the realities of China's labor relations and labor legal system.
