1. Since the founding of the People's Republic of China, the National People's Congress and its Standing Committee, as well as the State Council (including the Central People's Government and the State Council), have formulated a large number of laws and administrative regulations. With the development and changes in the situation, the country has been formulating new laws while also amending or abolishing existing laws. Especially at the end of 2001 and the beginning of 2002, to adapt to China's entry into the WTO, the country conducted a review of existing laws and administrative regulations, formulating and amending a batch of laws and administrative regulations.
2. This book is compiled on the basis of the review of all laws and administrative regulations since the founding of the country. It includes all currently effective laws and administrative regulations from the founding of the People's Republic of China to the present, totaling 883 items, including 291 laws and decisions or interpretations on legal issues, and 592 administrative regulations. The cut-off date is December 31, 2004.
3. This book is compiled based on the requirements of readers after thorough deliberation. Compared with existing legal and administrative publications in China, it has the characteristics of large volume, comprehensive coverage, innovative arrangement, and practical convenience, making it suitable for government agencies, organizations, enterprises and institutions, their staff, and the general public, especially government officials, legal professionals, and faculty and students of universities and colleges, in their study and implementation of laws and administrative regulations.
4. The laws and administrative regulations included in this book are categorized into seven major categories based on legal departments: Constitution, Civil and Commercial Law, Administrative Law, Economic Law, Social Law, Criminal Law, and Litigation and Non-Litigation Procedure Law. At the same time, to facilitate readers' reference, this book adopts the following arrangement methods:
(1) Subdivides the major categories into subcategories and smaller categories.
(2) Adds a letter index after the table of contents, selecting one or more letters from the pinyin of the main words in the names of laws and administrative regulations, arranged in alphabetical order (A, B, C, D).
(3) Includes the texts of laws and administrative regulations that have been amended or revised, with detailed explanations of the amendments or revisions provided in the text notes. Relevant amendment bills or revision decisions are not included.
(4) For laws (such as the Law on the Protection of Minors, the Railway Law, etc.) that cited criminal law provisions before the revision of the Criminal Law by the fifth session of the eighth National People's Congress on March 14, 1997, the cited provisions remain those of the pre-revision Criminal Law. Please note when using them.
5. When this book was compiled, some implementation regulations of newly revised laws had not yet been revised, and there were inconsistencies with the newly revised laws. Please note when using them.
