Features: China is a nation that values etiquette, and the Chinese nation upholds the virtue of "harmony is paramount." Traditional Chinese culture has always emphasized and pursued the spiritual essence of "harmony." Litigation mediation is an important litigation system in our country and a significant way for people's courts to exercise judicial power. The functions of litigation mediation are as follows:
First, it can reduce the antagonism of the litigation process, promote mutual understanding and cooperation between the parties, and is beneficial to maintaining the long-term interests and friendly relations of both parties in resolving civil disputes.
Second, the process is flexible, allowing disputes to be resolved quickly, conveniently, and economically, alleviating the burden on the parties, reducing litigation costs, and achieving an organic unity of legal and social effects in case handling.
Third, mediation emphasizes active participation by the parties, which is conducive to the parties fully exercising their right of disposition.
Fourth, mediation agreements are based on mutual consent, making them more easily accepted and voluntarily implemented by the parties, avoiding difficulties in enforcement, and achieving an organic unity of mediation and enforcement.
Fifth, in situations where substantive legal norms are inadequate, parties can explore win-win outcomes through negotiation and compromise during mediation.
At the current historical period of comprehensively building a moderately prosperous society in all respects, resolving cases through mediation is of great significance for resolving various social conflicts, maintaining social stability, and serving economic development. This is precisely what is captured by the saying: "In resolving disputes, mediation is the best approach; enforcing the law should also consider the people's customs; harmony can resolve grievances, and gentle rain blooms flowers."
In August 2004, the Supreme People's Court issued the "Regulations on Several Issues Concerning the Mediation Work of People's Courts in Civil Litigation," which further standardized and improved litigation mediation. Against this background, Comrade He Ming, the Vice President of the Ningde Intermediate People's Court, edited the book "Civil Litigation Mediation Skills and Case Analysis."
The success of mediation largely depends on the summary of experience. The book "Civil Litigation Mediation Skills and Case Analysis" not only summarizes and refines dozens of commonly used and effective mediation techniques in civil litigation mediation but also demonstrates and explains the techniques and methods used through rich and vivid cases of successful mediation. These immersive cases help judges understand and grasp the appropriate use of various mediation techniques, gaining intuitive and profound impressions, thereby transforming others' successful experiences into their own insights.
I believe that the publication of "Civil Litigation Mediation Skills and Case Analysis" holds significant importance in summarizing the experience and skills of courts in mediation work, enriching the means of mediation, fulfilling the requirement of "serving the people through justice," and helping judges effectively apply mediation techniques in future judicial work to improve the success rate and resolution of mediation cases.
As the saying goes, "To make a tree grow tall, one must firmly anchor its roots; to make a river flow long, one must dredge its source." Deep roots can bear lush leaves, and a distant source can sustain a long flow. For judges, continuous exploration in the field of adjudication, honing their skills in practice, and improving their quality through theoretical research are essential. This is the second book on litigation mediation edited by Comrade He Ming, and from it, I see the spirit of our judges' dedication to practice and bold theoretical innovation. This is the preface.
