Features: In recent years, with the strong growth of China's exports to the United States and the sustained sluggishness of the U.S. economy, Chinese export enterprises have increasingly been plagued by U.S. anti-dumping actions. In dealing with U.S. anti-dumping measures, the primary negotiation targets for Chinese enterprises are the U.S. Department of Commerce and the U.S. International Trade Commission, which are at the forefront of U.S. anti-dumping operations and belong to the administrative hierarchy. Meanwhile, the U.S. Court of International Trade, which operates in the second tier of U.S. anti-dumping proceedings, is responsible for supervising the fairness of rulings made by the U.S. Department of Commerce and the U.S. International Trade Commission. However, due to confusion and a lack of clarity, Chinese enterprises often miss the opportunity to seek judicial relief. In light of this, introducing Chinese enterprises to the operational mechanisms of the U.S. Court of International Trade in handling anti-dumping cases and assisting them in understanding and mastering the current set of fundamental principles applicable to anti-dumping cases involving non-market economies has become an urgent priority in anti-dumping research. The writing of this book is based on this premise. By analyzing 29 anti-dumping cases involving Chinese products heard by the U.S. Court of International Trade from 1999 to 2002, the book provides a detailed elaboration of the views of U.S. judges and conducts an in-depth study of the principles revealed in these cases.
