Features: This book provides an updated presentation of the fundamental concepts and the institutional system of the property law, and conducts a more specific discussion on the property law system under China's market economy system. The updates to property law knowledge in this book are primarily reflected in two aspects:
(1) Clearing up the misconceptions and distortions about the legal principles of property law in previous years based on foreign literature, and re-establishing a scientific system of property law knowledge.
(2) Clearing up the conceptual and institutional systems established under the planned economy needs in Soviet civil law, and establishing a theoretical foundation for the development of property law in China's market economy. The focus of this book is to propose a property law system that aligns with China's conditions, based on the legal principles of property law and the conclusions of practical investigations. Additionally, property law must regulate property transactions and address the protection of third parties in property transactions. Establishing the security of property transactions has been largely overlooked in past property law knowledge. The systematic framework proposed by this book for addressing the static order and dynamic security issues of property law has been largely adopted in the draft property law bill currently being formulated in China.
